According to the complaint, the defendants are alleged to have violated certain provisions of the Securities Exchange Act of 1934. Specifically, the complaint alleges, among other things, that Spectrum made repeated false and misleading statements concerning the ability of Evomela to drive the Company’s revenue and provided assuring statements that the U.S. Food and Drug Administration (FDA) would approve its New Drug Application (NDA), allowing the drug to be marketed immediately. Then, on October 23, 2015, Spectrum announced that it had received a Complete Response Letter from the FDA in response to its New Drug Application seeking clearance for Evomela, indicating that the FDA cannot approve the application in its present form. Spectrum stock dropped significantly immediately following this announcement.
