According to the complaint, the Company made false and/or misleading statements during the Class Period by filing documents during its Secondary Public Offering which failed to disclose that: 1) the Company had declining customer demand in its Texas market; 2) there was disruption caused by the transition of the Company’s call center operations; 3) declining customer demand and market share losses because of La Quinta’s outdated facilities which needed major renovations; 4) the repairs and renovations would require significant capital and operational disruption; 5) La Quinta exaggerated the total buyers willing to pay for some of its properties; and 6) all of the above would likely have an adverse effect on the Company’s future operating results.
