Court Upholds Keller Rohrback’s Claims Against Nationstar Mortgage and Solutionstar for Alleged Excessive Inspection Fees

The Contreras complaint is on behalf of homeowners from multiple states and alleges that Nationstar, together with its subsidiary Solutionstar, use an automated system to illegally, unfairly, and fraudulently charge borrowers for multiple and repetitive “property inspections,” and other fees. This system and the fees being charged are not required nor permitted by lenders or by federal regulations and guidelines.

On August 10, 2017, the Court issued an order upholding nearly all of the claims, noting that “Plaintiff has sufficiently alleged that Defendants engaged in deceptive conduct in the servicing of Plaintiff’s loan.” According to Keller Rohrback partner Derek Loeser: “Nationstar’s and Solutionstar’s abusive servicing practices have subjected our clients to inappropriate and excessive fees.
