FORT WORTH, Texas, Sept. 25 /PRNewswire/ -- Fort Worth plaintiffs' attorney John David Hart and other Texas lawyers will be making their way to the courthouse in the next few days to file additional Vioxx lawsuits before the Texas statue of limitations expires on Sept. 30, 2006.

Mr. Hart, founder of The Law Offices of John David Hart, says he will be filing 22 or more new Vioxx claims before the Sept. 30 deadline, in state and federal courts in Texas and throughout the United States.

"Unfortunately, many Vioxx users don't realize the filing deadline is upon us in many states, including Texas," says Mr. Hart. "This is a very dangerous drug that produced terrible results, and we plan on making sure our clients get their day in court."

Whitehouse, NJ-based pharmaceutical company Merck & Co. Inc. (NYSE:MRK) withdrew Vioxx from the market on Sept. 30, 2004. Merck's actions came after one of the company's own studies showed Vioxx use doubled the incidence of heart attacks and strokes in patients. Other studies suggest the risk of cardiovascular problems among Vioxx users is even higher.

Under Texas law, all patients who took the drug and suffered injuries must file their claims by Sept. 30, 2006, in order to comply with state statute of limitations laws. States other than Texas may have different limitations for filing of Vioxx claims.

Mr. Hart says he's filing one wrongful death case related to Vioxx use and others in which Vioxx users suffered heart attacks, strokes, pulmonary embolism, deep vein thrombosis and other injuries.

"It is our hope that everyone who has been injured by this drug realizes the deadlines that are in place and that they take appropriate action to protect their legal rights," Mr. Hart says.
