Brisbane Migration Agent Coins ‘Parent Visa Loophole’

In Australia, as in many countries spanning the globe, residents are constantly applying for visas for their parents and loved ones. A parent visa in Australia allows the holder to remain living in the country with their child or children who are either Australian citizens or permanent residents. While the process for applying for these parent visas is not as extensive as that of applying for a partner visa, it can still be daunting.

Brisbane, Australia- In Australia, as in many countries spanning the globe, residents are constantly applying for visas for their parents and loved ones. A parent visa in Australia allows the holder to remain living in the country with their child or children who are either Australian citizens or permanent residents. While the process for applying for these parent visas is not as extensive as that of applying for a partner visa, it can still be daunting. Salvo Migration, a leading immigration agency in Brisbane Australia, with an extensive knowledge of visas, have recently provided information to the public regarding a loophole in the visa system, which will alleviate much of the headache for parents of Australian citizens looking to live in the country.

The Parent Visa Loophole, as it has been coined by Salvo Migration, is still a process, much like any other visa process. In this process, parents of Australian citizens and permanent residents are able to first enter the country on a Visitor/Tourist visa. From there, as long as the parent is over the age of 65 and meet all other visa criteria, they are then eligible to apply for an Aged Parent visa from inside of Australia. In doing this, applicants will be granted a ‘Bridging Visa’, which will allow them residence in Australia until such time as a decision has been made on the Aged Parent Visa. Now, here is where the loophole comes into effect. Aged Parent visas currently have a processing time of 30 years or more. Due to the extensive processing time alone, parents are essentially granted an ‘indefinite’ Bridging Visa to remain in Australia.

The biggest benefit of this loophole in the Australian visa process is not that it cuts down on the actual visa wait process, but that it bypasses the need for parents to pay the exorbitant 2nd Visa Application Charges which are associated to the faster processed ‘Contributory’ Parent visa pathways. These fees are currently at an all time high of $43,600 per adult applicant, meaning that a husband and wife applying for a Contributory Parent visa will be subjected to $87,200 in 2nd Visa Application Charges, which does not include the initial charges associated with such visas. Although these visas can be granted in much less time compared to non-Contributory Parent visas, as the charges begin to add up, it becomes even easier to see why the Australian Parent Visa Loophole is a better option for those who are eligible.

“As is often the case with aging parents, they begin wanting to be closer to their children and grandchildren,” explains Immigration Lawyer and Director, Martin Salvo. “But the process for visas is not only lengthy, but very costly. The PLH is a comparably inexpensive way for parents of Australian citizens or permanent residents to enter the country under certain circumstances. Because the processing times for Aged Parent Visas can take well over 30 years, this essentially is a way for parents to remain indefinitely, and legally, in the country with their children without needing to apply for the much more expensive Contributory Parent visas as a way of staying in Australia.”

The Parent Visa Loophole is a way for parents of Australian Citizens and permanent residents to live in the country. This loophole is entirely dependent on applicants meeting criteria like the balance of family test, being over the age of 65, not having a ‘No Further Stay’ condition on their Visitor visa, and satisfying all other Aged Parent visa criteria. Salvo Migration, a dedicated Brisbane team of immigration lawyers and migration agents, have successfully utilized the Parent Visa Loophole for their clients, which has helped parents hoping to enter the country to be with their children and avoid unnecessary costly Visa fees.
