Living Trust - What is it? Why do I Need it?

By: PRLog
PR Log - Jul 24, 2012 - If you want to make certain your property is passed on to your loved ones – you need a Living Trust. A Revocable Living Trust is a legal document that you create which includes your instructions as to how you want your assets distributed when you die – without going through the lengthy and expensive probate process.

The Florida Association of Legal Document Preparers, http://www.faldp.org/livingtrustdocprep.html, is now preparing Living Trusts for Florida residents. Included with the Living Trust documents are other essential estate planning documents such as a Living Will, and an Advance Health Care Directive. With a Living Trust you can rest assured and later on rest in peace, knowing that your loved ones are going to receive the property you promised them – without having to wait for a judge's order to make it so.

With a Living Trust, http://www.faldp.org/Revocable-Living-Trust.html,  parents can transfer real property, such as the family home, to their heirs  seamlessly without needing a judge to order the transfer.  No court or judge needs to interfere with how you want your property distributed. While you're alive, you can do anything with your property that you could do before you placed it in your trust - including buying, selling, renting, and improving. And when you die or if you become incapacitated your property is immediately in the control of a trusted person or persons that you named. Many people name an adult child or close relative to take over, this person is called a Successor Trustee. The Successor Trustee, your heir, takes over where you left off – steps right into your shoes without a lengthy detour in the courthouse.

Estate planning and probate is a legal area cloaked in mystery. Probate is the legal process in which a deceased person's property is distributed to that person's designated heirs. Many people believe that having any sort of a will avoids probate – but this is a myth. A will does not avoid probate at all, and is not designed to do so. A will makes your wishes known – that's all. A will does not transfer property ownership.

The Florida Association of Legal Document Preparers, http://www.faldp.org/livingtrustdocprep.html, is now offering preparation of Living Trust and Estate Planning documents for only $795. Please visit us online to learn more about our services. We will refer your inquiry to a member legal document preparer in your area, if possible. Or one of our in-house documents preparers will prepare your documents for you. Either way you have our personal service. We and our members use HotDocs software, which has over 1 million users; and is the same software used by 80% of estate attorneys and financial planners.
