Workers Marching to Illinois Department of Human Rights to File Discrimination, Harassment Class Complaint Against WaterSaver Faucet

After multiple negotiating sessions, no progress has been made to end bathroom monitoring and harassment at WaterSaver Faucet Co., nor drop the unlawful demand that the workers’ Union - Teamsters Local 743 - cease all contact with the EEOC, OSHA and Illinois Department of Human Rights.

On Monday July 28th, workers and allies will rally at 3:30pm outside of the WaterSaver Faucet Company, 701 W. Erie St., Chicago IL 60631, immediately followed by a march to the Illinois Department of Human Rights, 100 W. Randolph Street, Chicago IL, 60601, to file a class complaint on the mass-discipline, bathroom monitoring and the company’s unlawful demand to silence workers.

Talks over a new collective bargaining agreement have stalled, with WaterSaver Faucet Co. refusing to negotiate on the subject of the recently installed electronic washroom monitoring system or management’s practice of interviewing and disciplining workers who average more than 6 minutes a day over a two week period, in the bathroom.

"HR literally goes through every person's bathroom use and either hands out a reward or discipline," said Nick Kreitman, an attorney for Teamsters Local 743, which represents 80 workers at the plant, which coincidentally manufactures taps and other sink fixtures.

WaterSaver Faucet’s owner, Steve Kersten, has been absent from the bargaining table, though he was available to deliver television interviews an hour prior to one bargaining session.  In his stead, the Company retained a $400 an hour labor counsel from Franczek Radelet P.C. 

Unfair Labor Practice charges are still pending against WaterSaver Faucet for failure to bargain in good faith over the washroom issue and for conditioning any deal on the Union’s agreement to cease contact with state regulatory agencies.

Workers at WaterSaver Faucet continue to fight for respect over the recent discipline of 25% of the plant’s workforce (19 out of approx. 80 workers) for “excessive bathroom usage”. This comes only four days after asking the Company for $15 per hour paid sick days,  in accordance with the proposed City of Chicago ordinance, insurance co-pay reimbursement and a progressive disciplinary policy.
