Allen Matkins Elects Anthony Burney, Ted Fates, Heather Riley and Ryan Waggoner to Partnership

Allen Matkins, a California-based full service real estate and business law firm, announced today that real estate attorney Anthony R. Burney in its San Francisco office, insolvency and receivership attorney Ted G. Fates and land use attorney Heather S. Riley in its San Diego office, and real estate litigation attorney Ryan T. Waggoner in its Los Angeles office, have been elected to the firm partnership. The election is effective as of July 1, 2015.

Anthony Burney

Anthony's practice covers the full spectrum of transactional real estate, including leasing, financing, acquisitions and dispositions. He frequently drafts and negotiates office, retail and industrial leases for institutional and other regional landlords and has represented tenants in retail and office lease transactions throughout the West Coast. His finance practice includes the representation of lenders and borrowers in loan originations, loan assumptions, enforcing defaulted loans and the California foreclosure process. Anthony is a former board member of The Belden Club, a premier real estate professional association in San Francisco, and has been named a Super Lawyers "Rising Star" the past two years.

Most recently, Anthony represented an institutional landlord client in connection with an 80,000 square foot industrial lease and option to purchase for warehouse space in Northern California. Anthony has also recently represented a San Francisco based real estate investment company in connection with three separate acquisitions and financings of retail shopping sites in the southern United States.

Ted Fates

Ted is a member of the firm's Receiverships, Bankruptcy, and Real Estate Finance practice groups. His practice focuses on representing creditors, receivers, and trustees in insolvency and litigation matters. He also specializes in equity receiverships initiated by federal regulatory agencies and has represented equity receivers appointed for various securities trading and investment firms, real estate and healthcare industry lenders, Internet-based investment programs and Ponzi schemes. Collectively, these entities have raised more than $2.5 billion from their participants. His clients also include state court receivers appointed to manage and/or sell real estate and other business assets.

Ted is a Director of both the Bankruptcy Forum and the California Receivers Forum and is a past president of the Federal Bar Association, San Diego chapter. He is also an active member of the National Association of Federal Equity Receivers, including co-chairing the organization’s Agency Outreach Committee and speaking at its upcoming Annual Conference taking place in San Diego. He was previously named a "Top Young Attorney" by the San Diego Daily Transcript and this year was named a Super Lawyers "Rising Star."

Heather Riley

Heather's practice involves a variety of land use and environmental matters, with a particular emphasis on the California Environmental Quality Act (CEQA) compliance and writ litigation. She has experience with large and small-scale residential, commercial, mixed-use, educational and infrastructure development and redevelopment projects across California. Most recently, she helped Kilroy Realty secure entitlements for the One Paseo mixed-use project in San Diego. Other high-profile projects that Heather has worked on include the Gregory Canyon Landfill and the Colorado River Quantification Settlement Agreement (QSA). In addition to her land use and environmental practice, Heather’s experience includes endangered species, water and airport law matters.

The Building Industry Association of San Diego County recognized Heather as the "Builder Associate of the Year" in 2011, and she was named to San Diego Metro's 40 Under 40 list in 2013. In 2015, Heather was named a Super Lawyers "Rising Star" and included in San Diego Business Journal's "Best of the Bar" list. In December of this year, Heather will be sworn in as the 2016 President of the San Diego County Bar Association, the region’s oldest and largest law related organization.

Ryan Waggoner

Ryan is a real estate litigator with a practice that focuses on real estate-related dispute, including the financing of projects, construction litigation, and disputes between commercial landlords and tenants, buyers and sellers of real estate, and participants within an ownership group. He has successfully resolved a variety complex disputes at every level, through pre-litigation negotiations, mediation, arbitration and traditional litigation. Most recently, Ryan represented a Canadian development company in connection with a former buyer’s recordation of a lis pendens days before the client’s scheduled closing date to acquire an office building in downtown Los Angeles, forcing a withdrawal of the lis pendens only 41 days after it was recorded and paving the way for the transaction to close.
