FDA Ruling Threatens Largest U.S. Vape Hardware Manufacturer

ProVape Could be One of Thousands of Small Business that Will Likely Shut Down As a Result of the FDA’s New E-Cigarette Regulations

Monroe, WA -- (ReleaseWire) -- 05/13/2016 -- ProVape, maker of the ProVari and the largest vape hardware company in the U.S., will be one of thousands of small businesses that will end up closing its doors as a result of the FDA's new e-cigarette regulations.

Founded in 2009 by David Flagg and Philipp Schuessler, ProVape has shipped over 450,000 devices to 67 countries all over the world. While the vast majority of vaping devices are made in China, ProVari devices are designed by former aerospace and military engineers and made in the U.S. using primarily U.S.-made components and electronics.

Flagg says the FDA's ruling puts millions of people who successfully switched from smoking to vaping at risk of returning to cigarettes.

"The FDA will require any product not on the market before February 2007 to go through an arduous pre-market approval process that could cost over $1 million per product," Flagg said. "Most vape businesses like ProVape don't have the means or wherewithal to put our products through this cost-prohibitive process and with no guarantee it would get approved."

The FDA's ruling will likely result in the vast majority of vapor devices and e-liquids to be pulled from the market within two years. "The FDA's regulations will drastically limit the choices that millions of vapers and an estimated 40 million adult smokers have to just a handful of products," Flagg said. "It makes it more difficult to switch to vaping, because the safest and most advanced devices like the ProVari will no longer be on the market."

For now, Flagg said it will be business as usual and ProVari will be sold online and in select stores. He advises vapers and anyone who wants to be confident they'll have a personal vaporizer that's safe, reliable and guaranteed to last to buy a ProVari this spring or summer.

"Meanwhile, we'll be working closely with the various vapor trade associations to do what we can to at least change the 'grandfather' date that could create a pathway for advanced vapor devices such as ProVari to remain on the market," he said.

Coincidentally, the Royal College of Physicians released a report in the same week as the FDA's e-cigarette ruling, but they endorsed vaping as a harm reduction option, stating that regulations should not inhibit the development or use of vapor products.
