One local trial recently came to a positive conclusion for the plaintiff involved. Port St. Lucie jurors awarded Jacqueline Burgess $3 million following the loss of her husband, Johnny, to lung cancer. Johnny Burgess began smoking in 1948 at the age of 14 years. This was almost two decades before the first caution labels were placed on cigarettes. He smoked unfiltered Pall Malls until 1965. He then switched to Winston filtered cigarettes, a move encouraged by the tobacco industry's indications filtered varieties were less harmful than unfiltered ones.
Mr. Burgess smoked up to two packs per day until 1982 at which time he quit. Despite ultimately putting cigarettes aside, damage to his lungs was irreversible. He was originally diagnosed with lung cancer which spread to his bones and liver. Burgess lost his battle with cancer in 1993. At that time, Mr. and Mrs. Burgess had been married for almost 40 years.
Jacqueline Burgess, on behalf of Mr. Burgess' Estate, sued the manufacturer of Pall Mall and Winston brand cigarettes, R.J. Reynolds Tobacco Company on claims of negligence, strict liability, fraudulent concealment and conspiracy to commit fraudulent concealment. After two and a half weeks, Port St. Lucie jurors found for Mrs. Burgess, resulting in the $3 million payout.
