Trial lawyer and injury victims advocate Bernard F. Walsh traveled with other Florida attorneys and Florida medical doctors to voice strong opposition to new bills introduced in the House and Senate that will gut fair compensation for injury victims and interfere with medical doctors ability to provide the best care.
PRLog - Mar. 20, 2014 - SARASOTA, Fla. -- The new legislation introduced included House Bill 379 from Florida State Representative Hood and Senate Bill 1128 by Florida State Senator Richter have been sharply criticized by Medical doctors and civil trial lawyers alike, as a brazen attempt by the insurance industry to drastically reduce compensation for badly injured victims of negligence.

Bernard Walsh a trial lawyer with the Sarasota law firm Shapiro Goldman Babboni & Walsh discussed the bills and upcoming vote with several other Florida attorneys and Medical doctors, and traveled to Tallahassee to in an effort to educate state lawmakers about the dire consequences the proposes bills would have for Floridians.

Experts have noted that the proposed changes would have a disastrous effect for both the rights of those badly injured in auto accidents or other negligence cases, and remove doctors from determining the medical treatment that their patients require. Additionally industry experts pointed out that the bills will also put the doctors and health care providers in a position where they may actually be forced to sue their patients to recover their costs, yet the wrongdoer and their insurance company escapes financial responsibility. Not only will this add burden to the injured party, but it clog the legal system with additional law suits.

Bernard Walsh had this to say about the proposed legislation,”For years it's been no secret that the insurance lobby is alive and well in Florida, but HB 379 and SB 1128 are among the most brazen attempts by the insurance industry to increase their already astronomical profits by reducing their requirement to act in good faith. I have come to Tallahassee with many of my colleagues and with those in the medical industry to inform lawmakers of the damaging effects these changes will have on their constituents.” Walsh continued with, “If these bills are made into law it will not take long for the thousands of Floridians injured every year to be left in economic disaster, unable to both pay for the medical treatment needed to fully recover from serious injuries, and unable to get the longterm care needed by doctors because of the uncertainty of payment for doctors as a result of the proposed changes.”
