On May 21, 2007, the United States Court of Appeals for the Sixth Circuit in the case of Chicago Title Insurance Corporation v. James A. Magnuson, et al. reversed the $32.4 million punitive damages verdict against a subsidiary of The First American Corporation (the Company) and ordered a new trial on the $10.8 million compensatory damages verdict. During 2005 the Company recorded a reserve of $10.0 million in connection with this matter. The Company is evaluating the appropriateness of this reserve in light of the decision of the court.
