Manhattan, New York – On January 13, 2019 at approximately 8:11 p.m.,a vehicle in which the firm’s client, Daryle W. was a passenger, was struck from behind, or rearended, by another vehicle. Accordingly, the law firm of Michael J. Redenburg, Esq. PC filed an action in Suffolk County Supreme Court bearing Index Number 620283/2020. The tortfeasor, or the wrongdoer who struck Daryle from behind only maintained a $50,000.00 policy of insurance providing for bodily injury protection, for injuries done to another. After that amount was accepted, we looked to Daryle’s Underinsured Motorist Protection through his own policy of insurance.
Daryle’s policy was a Florida policy, as he was relocating there having just retired. That policy hasd three autos covered, and each auto had $300,000.00 of Supplemental Underinsured Motorist Protection. Further still, those limits were stacked, and so there was $900,000.00, less the $50,000.00 already recovered available to further compensate Daryle for the injuries he sustained.
The law firm of Michael J. Redenburg, Esq. PC then filed a direct action against Daryle’s insurance company, USAA, for SUM benefits in Suffolk County Supreme Court bearing Index Number 202594/2022. After 2 & 1/2 years of protracted litigation, the parties decided to Mediate the matter before NAM. At the Mediation, USAA agreed to resolve the matter for $450,000.00. Therefore, Daryle recovered a total of $500,000.00: $50,000.00 from the car that struck him in the first lawsuit, and $450,000.00 from his own insurance company per the SUM provisions at Mediation.
