On November 4, 2008, Artes Medical, Inc. (the “Company”) issued a press release announcing that the
dissident investor group has requested the Company’s Board to consider an investment proposal
following the Company’s victories over the dissident investor group in U.S. Federal Court. A copy
of the press release is attached as Exhibit 99.1, and is incorporated herein by reference.
