As of December 24, 2012, DG Capital Management, LLC was an indirect benefical owner of 1,348,112 shares of Common Units. The percentages herein are calculated based upon the 22,660,137 shares of Common Units issued and outstanding as of March 9, 2012, as reported on the Issuer’s Form 10-K filed with the SEC on March 13, 2012.

Dov Gertzulin serves as managing member of DG Capital Management, LLC. Each of the DG Entities beneficially owns less than five percent of the shares reported herein. Each of the Reporting Persons disclaims beneficial ownership of the shares reported herein except to the extent of its or his pecuniary interest therein. There are also three separatly managed accounts each beneficially owns less than five percent of the shares reported herein.
