Concessionary rate of £50,000 investment is available to those who are switching into this category within the UK from a Post-Study Work visa or Graduate Entrepreneur visa. Applicants with PSW visa face an additional requirement in that they should be engaged in professional activity which is registered in the codes of practice for Tier 2 Sponsors as corresponding to National Qualifications Framework level 4 or above.
Tier 1 Entrepreneur visa allows settlement in the UK after five years of residence in this category. This also applies for dependants of Tier 1 entrepreneurs. Accelerated settlement option is available for businessmen whose business generated income of at least £5 million in the first three years or created not less than 10 permanent jobs. Applicants for indefinite leave to remain have to meet good character requirement and have passed a Knowledge of Life in the UK test.
Tier 1 (Investor) category (http://www.kadmos.org.uk/investor_visa.html/) offers more flexibility than its counterpart for entrepreneurs, in that Tier 1 investors are allowed to take up employment outside their immediate business and do not have to show evidence of knowledge of English.
Tier 1 investors have to demonstrate availability of £1 million for investment in the UK for a successful visa application in this category. The investment has to be made within three months of entering the UK.
Accelerated settlement option allows for applications for indefinite leave to remain after two or three years of residence depending on the level of investment. Funds of £10 million open the door to settlement after two years of residence, funds of £5 million – for accelerated settlement after three years.
Both investors and entrepreneurs can be absent from the UK for up to six months in any 12 month period, unlike Tier 1 (General) migrants who are only permitted absences of 180 days in the five year period leading to an application for indefinite leave to remain.
Same as all others, investors and their dependants are subject to good character requirement and have to pass a Life in the UK test for a successful application for settlement.
