One common mistake that people make is not getting an attorney for a personal injury case, according to Long, because they assume that they cannot afford one.

When asked to elaborate, she said, "There is no cost to someone hiring a personal injury attorney at the start. I work on a contingency fee basis, meaning that I take the fee at the end. I do not recover money unless I am able to recover money for you."

After hiring an attorney, the law firm will undertake an investigation, which is an essential part of a personal injury case. As part of the investigation, an attorney such as Long will collect evidence including potential witnesses, police reports, a copy of the 911 call, and insurance information.

According to Long, the client's job is to get treatment and get better during the investigation.

“Clients treat until they are either 100% better and back to their pre-injury status or what we call maximum medical improvement, which means you are as good as you’re going to get, but it’s not back to what you were.”

Long was quick to add that she takes over communication with a client’s insurance company so that they can focus on getting better instead of worrying about medical bills.

After a client seeks treatment, Long then compiles all the evidence she’s collected into a demand letter and sends the letter with a dollar amount to the insurance company.

"From there, it typically takes 30 days to get back, we negotiate for about a week, and we know from an offer whether or not a case is going to settle. 95% of the time, negotiation is really successful, and we're able to resolve the case at that stage, and a few weeks later, you'll have your check in hand."

According to Long, not every personal injury firm prepares a case for trial, which is something to keep in mind when searching for the right representation.

"Some lawyers will tell you right away that they are not litigators, meaning that they will never take your case to trial. They will do all the work to prepare your case, but when it comes time to go to court, you'll have to find someone else to represent you," she added.
