Cortes Says Court's Decision Affirms Department's Position in Voter Activity Case

HARRISBURG, Pa., Oct. 30 /PRNewswire-USNewswire/ -- Secretary of the Commonwealth Pedro A. Cortes today said that a decision by Commonwealth Court today affirms a Sept. 4 memo by the Department of State providing guidance on voters' Election Day activities.

In the memo, the department advised that the Election Code provides for the counties to make determinations about Election Day activities at the polling places.

"Our paramount concern has always been to ensure that every eligible, registered voter is allowed to vote," said Cortes. "On Election Day, we want to ensure that there are no unnecessary barriers to voting. Voters should not be turned away solely on the basis of wearing a t-shirt or button.

"Today's decision affirms our guidance to the counties that they are to make the determination about Election Day activities at polling places. I encourage voters to check with their counties to learn the policy on Election Day activities in their area."

The department's guidance also stated that district election officials and poll watchers cannot wear t-shirts or buttons expressing support of a candidate.
