Since the U.S. Constitution tasks grand jurors with determining whether criminal charges are warranted, federal judges generally hesitate to even consider motions for dismissing indictments. An improper dismissal can not only thwart the grand jury’s role, but also jeopardize the entire criminal justice process.  This is because dismissing a grand jury indictment prevents a trial jury from hearing, evaluating, and judging the facts of a case and determining the defendant’s guilt. As a result, even evidence of innocence may not support a motion to dismiss a federal grand jury indictment.
