Evans Moore, LLC, A Medical Malpractice Lawyer, Achieves 3.1M Dollar Settlement in a Wrongful Death Trial

Georgetown, SC - Evans Moore, LLC recently achieved a $3.1 million settlement for the family of a deceased woman following a wrongful death claim in Georgetown. The case stemmed from a T-bone car crash in which the victim was struck on the driver’s side. Despite being rushed to a local hospital, the medical staff failed to diagnose and properly treat the condition. Unfortunately, the negligence led to a herniated stomach, a condition that worsened and contributed to the victim's untimely death. 

The family was represented by attorneys Scott C. Evans, James B. Moore III, and George W. Bryan of Evans Moore, LLC. Working together, the three medical malpractice lawyers in Georgetown provided several strategic and practical advantages, including comprehensive case coverage, stronger collaboration, and increased efficiency.

 

Thanks to the team’s efforts, the firm secured a settlement with one of the medical practices before the case could proceed to trial. However, the other medical practice remained uncooperative, compelling Evans Moore, LLC to take the case to trial.

To strengthen their position, the firm enlisted the support of two expert witnesses. Dr. William Cheadle, a trauma surgery expert, provided testimony on medical errors and standard of care, emphasizing that the medical practices involved owed the deceased a duty of care. The personal injury lawyer in Georgetown also brought in Oliver Wood, Jr., PhD, an expert in economic loss, who accurately calculated the total damages suffered by the family due to the wrongful death.


As the trial neared its conclusion, the judge issued a directive that significantly shaped the case’s outcome. The jury was tasked to answer specific questions, including whether there were multiple distinct acts of negligence and whether the defendant’s conduct rose to the level of gross negligence.

 

Shortly before closing arguments, the remaining defendant agreed to a settlement that reached the maximum amount allowed by the deceased’s insurance policy. This decision was likely influenced by the judge’s direction and the strong case presented by Evans Moore, LLC. The defendant’s desire to avoid a potential verdict against them may have played a significant role in their decision to settle.

 

The case concluded with a $3.1 million settlement for the family, an amount that provided some measure of justice for their loss. The settlement reflected not only the damages associated with the wrongful death but also the impact of the medical negligence that led to it.
