This implies that if a person bought a car that had an open recall, or if he asked about the condition of the vehicle, the dealer had a responsibility to inform him about any damage or safety recall, and possibly not have sold the car until it defect or recall was remedied. The dealer may have put the consumer in danger including potential death by doing so. That consumer might be eligible for compensation as a result under California’s Consumer Legal Remedies Act (CLRA) Cal Civil Code Sections 1750 ET. Seq.
