Dell & Dean Is Retained to File a Lawsuit Against Waters Edge Nursing Home for Wrongful Death

Dell & Dean PLLC announced today the firm is representing surviving family members in a nursing home/medical malpractice lawsuit against Waters Edge Nursing Home in Port Jefferson, alleging wrongful death.

From December 2022 until February 2023, the decedent was under the care of Waters Edge Nursing Home. On the evening of February 3, 2023, the nursing home facility contacted the decedent’s son to advise him that his mother was non-responsive/unresponsive. The nursing home staff pronounced her dead on February 4, 2023. 

The family made arrangements at OB Davis Funeral Home. Her body was transported to the funeral home in a body bag. After arriving, they called the decedent’s son advising him that his mother was in fact alive and that they sent her by ambulance to Mather Hospital, where medical staff took extraordinary measures to preserve her life. Unfortunately, she died 14 hours later. 

The family is now bringing a lawsuit for wrongfully pronouncing their mother deceased, suffocation by way of a body bag, mishandling of the decedent’s body, conscious pain and suffering, and wrongful death. The New York State Attorney General and the Department of Health are also investigating this matter.
