Legal Help For Veterans Comments on $100 Million in VA Claim Errors

Northville, Michigan – Legal Help for Veterans, a Michigan-based veterans benefits law firm, has encouraged former service members to review their disability claims following a report from the Department of Veterans Affairs (VA) Office of Inspector General. The report revealed that mistakes by VA employees during the processing of claims for veterans rated as 100 percent disabled have led to roughly $100 million in incorrect payments. The amount consists of $9.8 million in overpayments and $84.7 million in underpayments.

According to the VA watchdog, the errors stem from claims processors failing to follow established policies and procedures. The report estimates that between May 2022 and April 2023, approximately 75 percent of claims granted or denied for veterans with a 100 percent disability rating were improperly handled. The mistakes have caused veterans to receive incorrect compensation, prolonging the time it takes to resolve their claims and, in many cases, leaving them without the full benefits they are owed.

“It is unacceptable that so many veterans are affected by these administrative errors, and it is time for better oversight of claims processing procedures,” said Jim Fausone, a VA benefits attorney with Legal Help for Veterans, emphasizing the gravity of the issue. “Veterans have already sacrificed for their country and should not have to fight the system to get the disability compensation they deserve. Delays and inaccuracies in processing claims only add to the struggles of former service members.”

The errors disproportionately impacted veterans rated as fully disabled but considered unemployable due to service-connected disabilities. The mistakes mean many veterans are now facing financial hardship and stress as they await the resolution of their claims.

The report noted that many claims processors hired under the PACT Act, which expanded disability benefits for toxic exposure, were not adequately trained, leading to increased mistakes. In response, the VA has committed to improving training and oversight.
