Miami Car Accident Attorney David Charlip Explains Yielding the Right of Way in Florida

The lawyer mentions that in 2019, more than 540,000 cars were involved in accidents due to failure to yield the right-of-way. This is still one of the five leading causes of car crashes in Florida. 

According to the Miami car accident attorney, “Failure to yield right-of-way accidents are frustrating in that even if you as a driver are exercising the utmost caution possible when driving, it is still possible for you to be involved in a car accident through no fault of your own.” 

The lawyer explains that Florida law doesn’t specify who is entitled to use the right-of-way. The law instead sets rules about when a person must yield in certain traffic situations. Allowing another vehicle to cross an intersection ahead means that the driver is willing to yield. This is done to avoid accidents in places where traffic rules may not be clear, such as those without signs or lights. High chances of car crashes occur when drivers rush or are distracted.

According to the Federal Highway Administration, approximately 25% of traffic-related accident deaths or injuries in Florida involve intersections. In 2021, there are approximately 1,100 car accidents in the state each day, and 40 percent of them involve intersections. Half of all fatal accidents involving cars occur at intersections, with 20 percent occurring in the vicinity of an intersection.

Despite efforts being made to reduce the risk of accidents at intersections (such as the better design of signals and markings), accidents still happen because of driver error and the sheer volume of traffic in that space. 

Attorney Charlip says that authorities encourage people to learn more about yielding the right-of-way rules in order to prevent accidents. Florida Statutes 316.121 and 316.125 provide guidelines for pedestrians and drivers alike on how to behave at intersections in order to reduce the chance of an accident.

In the article, the lawyer adds, “At stop signs, yielding to all other traffic and pedestrians is required. Only move ahead when the intersection is clear. In the event that two vehicles reach a four-way stop simultaneously, the rules of yielding require that the driver on the right can move forward first.”
