Michigan DUI Lawyer Paul J. Tafelski Explains DUI Arrests

Michigan DUI lawyer Paul J. Tafelski (https://www.michigandefenselaw.com/dui-arrest.html) released a new article explaining DUI arrests in the state. The lawyer mentions that most DUIs are charged as misdemeanors. While they may seem less severe than felonies, misdemeanors should still be taken seriously. A misdemeanor conviction can result in increased penalties for subsequent offenses. 

“Most police officers know that they need a reasonable suspicion of criminal wrongdoing to pull over a driver. They may not admit that they pulled you over without a reason. Accordingly, it is critical to have a seasoned attorney look into the circumstances of the initial stop, as well as the events leading up to the DUI arrest. As soon as you are pulled over, and an officer comes up to the car window, he is making observations that could be grounds to arrest you,” says the Michigan DUI lawyer

The lawyer adds that after a police officer suspects that a person was drunk driving, every interaction is about gathering evidence to support his probable cause for arresting the said person. The majority of interactions with police can be recorded by either their body cameras or in-car video systems. The videotapes often preserve evidence that either supports the defense or leads to a plea deal for the drunk driver. 

In Michigan, drunk driving is also called operating while intoxicated or driving while intoxicated. DUI charges are brought when a driver operates a vehicle while under the influence of alcohol, liquor, drugs, or a combination of these things. It may be possible to avoid jail time if it is the first offense or misdemeanor DUI. 

Attorney Paul J. Tafelski adds that for a misdemeanor, a person may be sentenced to a maximum of one year in jail, and for a second offense, a maximum of seven years. Both these jail times will be in the county jail. The limit for drunk driving in Michigan is 0.08, however, depending on other factors, a person may still be convicted even if their blood alcohol content is lesser than 0.08. 

In the article, the lawyer explains that physiological factors play a big part in how alcohol affects a person’s body. The amount of alcohol-eliminating chemicals varies from one person to another. Women have more body fat than men so alcohol stays in their bloodstream for a longer period. 

Attorney Tafelski adds, “A male driver’s average rate of elimination is 0.015 an hour and 0.018 for a woman driver. People believe that women will eliminate faster, which is why they get drunk quicker. However, the main reason women get drunk quicker is that they have more fat. The alcohol is able to move more easily because it is concentrated in the same areas as the water.”
