Appeal Filed By Piotrowski Law Following Guilty Verdict In Officer's Shooting Death

Following a guilty verdict for Wisner Desmaret in the shooting death of police officer Adam Jobbers-Miller, Jaime Lapidus, Esquire, of Piotrowski Law, has filed an appeal according to court documents. Mr. Desmaret was sentenced to life in prison without the possibility of parole.

Jaime Lapidus, Esquire of Piotrowski Law, has filed to appeal the recent conviction of Wisner Desmaret in the 2018 shooting death of Officer Adam Jobbers-Miller. Desmaret, age 31, was found guilty of the murder. He was convicted of the crime and given a life sentence in prison without no possibility of parole. Fort Myers Police Department Officer Jobbers-Miller had responded to a call regarding larceny and assault at a gas station in July 2018. 

According to Lapidus, "Simply put, we firmly believe the proceedings that occurred throughout the life of Mr. Desmaret's case demonstrate clear and significant issues of constitutional concern and consequence that must be litigated in the appellate arena. We look forward to bringing those issues to light."

State Attorney Amira Fox and Assistant State Attorney Andreas Gardiner prosecuted the case. Although the state sought the death penalty in the case, the jury did not make the unanimous findings required under the law at the time the case was tried for a death sentence. In a release following the sentencing, Fox stated, "Officer Adam Jobbers-Miller is a hero who was performing his official duties in trying to stop the chaos caused by the defendant that day, just feet away from a very busy and populated roadway. His heroic actions in a dangerous and erratic situation exemplified what it is to be a law enforcement officer. He will forever be remembered."

Jobbers-Miller, age 29, has been a lifelong public servant and a member of the Fort Myers Police Department since September 2015. Jobbers-Miller fought for his life inside Lee Memorial Hospital for a week before succumbing to his injuries.
