The lawyer mentions that sometimes, because of emotions, people say things that they should not. However, threats of harm may be taken very seriously in New Jersey. Terroristic threats such as pointing a gun at someone’s head or brandishing a knife in someone’s direction can be charged with a crime of terroristic threats.

“A person is guilty of a terroristic threats crime of the third degree if he threatens to kill another with the purpose to put him in imminent fear of death under circumstances reasonably causing the victim to believe the immediacy of the threat and the likelihood that it will be carried out,” says attorney Lustberg.

Furthermore, the criminal defense attorney says that terroristic threats carry penalties of 3-5 years in jail, a fine of up to $75,000, and a probationary period. However, if the threats were made during a state of emergency, it may be punishable with 5-10 years in jail, a fine of up to $250,000, and a probationary period.
