The lawyer mentions that based on the circumstances of each case, the DWI charges and penalties may vary. “A person is guilty of Driving While Ability Impaired by alcohol or DWAI if they operate a motor vehicle while their ability to do so is impaired to any extent by the consumption of alcohol. Under the law, a person is guilty of a DWAI if they drive a motor vehicle on a public highway after consuming alcohol and their ability to operate that motor vehicle as a reasonable and prudent driver is impaired to any extent,” the Long Island DWI lawyer says.

The lawyer explains that for the first offense of Alcohol-DWAI, a person may have to pay a mandatory fine of $300-$500 and serve jail time of up to 15 days. If convicted, the person’s license may also be suspended for 90 days and will have to pay administrative fees depending on where the offense took place.

A person may be allowed to get a conditional license for defendants who attend a drug and alcohol rehabilitation program.
