CMS Direct Supervision Definition & Compliance Requirements: Guide Released

For compliant direct supervision, the CMS mandated that physicians must be “immediately available” to intervene with any adverse events that occur during a procedure. Traditionally, supervisory personnel were required to be physically present in the department at the time of the procedure to ensure that they could provide direction during complications. As of January 1, 2026, this requirement has been expanded to include virtual supervision, as long as the physician is present via two-way, real-time audiovisual technology throughout the whole procedure.

According to ContrastConnect, services that require direct supervision include level 2 diagnostic tests performed in physician offices and independent diagnostic testing facilities. Ultrasound, fluoroscopy, and contrast-enhanced MRIs and CT scans are among the services that cannot be performed without qualified personnel overseeing the procedure on-site or remotely. Incident-to services, which encompass services delivered by auxiliary personnel, also require direct supervision for complete reimbursement under Medicare.

However, ContrastConnect’s guide says that hospital outpatient departments operate under different rules, typically requiring supervisory personnel to be immediately available within the hospital campus or a provider-based department. Rural health clinics and federal health centers may also have different requirements. ContrastConnect advises administrators to familiarize themselves with these setting-specific rules to avoid compliance pitfalls, especially if they operate services across different care environments.

To ensure direct supervision is implemented according to CMS regulations, ContrastConnect recommends that organizations establish “supervision zones” within facilities for in-person direct supervision and install HIPAA- and HITECH-compliant audiovisual technology for virtual direct supervision. Administrators should also be aware of the distinction between direct supervision and general supervision, a less rigorous supervision model that is reserved for lower-risk procedures.

Finally, ContrastConnect’s guide notes that failing to document procedures and improperly billing incident-to services when supervision requirements haven’t been met can result in penalties, reimbursement denials, and legal exposure.
