Florida Alimony Reform Bill to Abolish Permanent Alimony, Establish a Duration Cap, and Make Other Major Changes Fails to Advance on April 1st, 2019

In March 2019, an alimony reform bill was filed in the Florida House of Representatives. The bill, HB 1325, along with sister bill SB 1596, were set to make changes to alimony laws – from abolishing permanent alimony to establishing a duration cap to allowing for retirement. The proposed legislation strived to ensure marriages fall into one of three categories: long-term (over 20 years), mid-term (11-20 years), and short-term (less than 11 years). The bills were expected to create a lot of debate when it comes to alimony, but failed to advance on April 1st, 2019. So what does this mean for residents of the state? The divorce rate is around 13% and those who get divorced may still be entitled to spousal support and alimony.

Cindy D. Sackrin, Divorce & Family Law Firm in Hallandale Beach, FL, helps those who may be entitled to spousal support and alimony if they have a need for it. She practices family law in particular – staying up-to-date on a range of issues, including but not limited to divorce matters, support issues, and other family law issues. Cindy D. Sackrin is a board-certified marital and family law specialist – who gives clients peace of mind knowing she is fully prepared to meet their unique needs.

She explained, “Divorce can be particularly stressful, especially when children are involved. That’s why it’s important to work with an attorney who focuses on family law issues, in order to ensure they’re skilled, experienced, and of course, personally concerned for the well-being of everyone involved.”

What does the law state about alimony?

Chapter 61.08 of the Florida Statutes sets forth the criteria used by the court, in order to determine the need for alimony. It is also important to keep in mind that alimony is entirely separate from child support, and in some circumstances, alimony can be permanent.
