She mentioned that court costs, attorney’s fees, and other expenses can add up, leading to what she described as “death by a thousand paper cuts.” These costs include fees for court processing, publishing notices in newspapers, and other administrative expenses necessary to settle the deceased person’s estate through probate. 

Additionally, Jennifer pointed out that attorney’s fees are a significant component of probate costs. Attorneys handling probate cases often bill by the hour, which can incentivize prolonging the process to increase their earnings. This financial incentive for attorneys can contribute to the overall cost of probate for the estate and the beneficiaries involved. 

Overall, Jennifer highlighted the importance of understanding the potential length and costs associated with probate. By showcasing real-life examples, and discussing the various expenses involved in the probate process, she underscored the need for individuals to consider alternatives, such as setting up a trust, to avoid the complexities and financial burdens of probate court. 

Therefore, Jennifer Surmacz underscores the importance of understanding that a will alone may not be sufficient to avoid probate. To truly bypass the probate process and its associated costs and delays, individuals should consider setting up a comprehensive estate plan that includes a trust. By establishing a trust and properly funding it with assets, individuals can ensure that their estate can be transferred to beneficiaries without the need for court supervision, ultimately avoiding the probate process altogether.

Jennifer served terms as 10th Circuit Lieutenant Governor of the American Bar Association LSD, and Vice President of Women’s Law Student Association.  She is a member of the American Bar Association, the Phi Alpha Delta legal fraternity, the Oklahoma Association of Justice, the National Association of Professional Women, Lawyers Fighting Hunger, and Gene Slay’s Boys and Girls Club.  Jennifer is also a black belt and national champion in Tae Kwon Do.
