Oberheiden P.C., a Federal Criminal Defense Law Firm Based in Texas, Secures Another Federal Indictment Dismissal

Houston, TX Oberheiden P.C., a federal criminal defense law firm headquartered in Texas, announced that it recently secured the dismissal of a client’s indictment in federal district court. According to Founding Attorney Nick Oberheiden, such outcomes are very rare.

Since the U.S. Constitution tasks grand jurors with determining whether criminal charges are warranted, federal judges generally hesitate to even consider motions for dismissing indictments. An improper dismissal can not only thwart the grand jury’s role, but also jeopardize the entire criminal justice process.  This is because dismissing a grand jury indictment prevents a trial jury from hearing, evaluating, and judging the facts of a case and determining the defendant’s guilt. As a result, even evidence of innocence may not support a motion to dismiss a federal grand jury indictment. To succeed, such a motion must be supported by complex legal arguments focused on prosecutorial miscues or flaws in the grand jury process.

Despite these challenges, Oberheiden P.C. recently secured the dismissal of a client’s federal indictment. This was the firm’s second complete dismissal of a federal criminal case in 2022. “With today’s court order, we have once again demonstrated our ability to help clients effectively and efficiently,” says Dr. Oberheiden, who served as lead defense attorney in the case. Dr. Oberheiden says that while such outcomes are rare, his firm evaluates the possibility of dismissal in every case, and he does not hesitate to pursue this challenging defense strategy when warranted.
