Moermond & Mulligan, LLC: Criminal Defense Lawyer in Dayton Secures Major Wins in Serious Cases

Cincinnati, Ohio: The Dayton office of Moermond & Mulligan, LLC has successfully resolved multiple complex criminal cases in both state and federal courts, achieving results that spared clients from prison time, deportation, and long-term legal consequences. These recent victories reflect the firm’s reputation for providing strategic, results-driven defense in serious legal matters.

One of the most significant outcomes involved a client charged with first-degree felony possession of methamphetamine in the Montgomery County Common Pleas Court. The Federal Crimes Lawyer in Cincinnati filed a motion to suppress key evidence, arguing it had been obtained unlawfully. The court agreed and sustained the motion, excluding the evidence. As a result, the prosecution was forced to dismiss the case entirely on August 7, 2025, clearing the client of all charges.

 

In another federal case handled by the Dayton office, a client, who was a green card holder and had previously been granted asylum, was indicted in the Southern District of California on charges of alien smuggling under 8 U.S.C. 1324. The stakes were high, as a conviction could have led to prison time and almost certain deportation. Leveraging their knowledge of both immigration and federal criminal law, the attorneys negotiated a favorable plea to Accessory After the Fact, a non-deportable offense. The client was sentenced to time served and avoided both additional incarceration and removal from the United States.

 

The drug crimes lawyer in Cincinnati also secured a dismissal in a particularly sensitive case involving a disabled client charged with 16 counts of aggravated arson and arson in Van Wert County. From the outset, the attorneys questioned the basis of the charges, suspecting a “case-clearing” motive. After requesting a thorough mental health evaluation, it was determined that the client was not competent to stand trial. The court dismissed the case, releasing the client from any further legal obligations.

 

A fourth notable win came in another Montgomery County case where a client faced a charge of having weapons under disability. The stop conducted by Huber Heights Police lacked probable cause and had no connection to ongoing criminal activity. The defense filed a motion to suppress, which was granted, resulting in the exclusion of the firearm evidence. When the State of Ohio appealed the ruling, the criminal defense lawyer in Cincinnati successfully defended the decision, and the case was ultimately dismissed.

 

In a separate matter, the firm represented a client who had been served with a Domestic Violence Civil Protection Order (DVCPO) and removed from his home. At the initial hearing, the team was able to demonstrate that the claims were unfounded, leading to the dismissal of the case and the client’s return to his residence.

 

The Dayton office also resolved a serious federal case involving a conspiracy to distribute over 400 grams of fentanyl. The client, also a green card holder, was facing severe penalties. The firm took over the case as second counsel and successfully negotiated a plea to a money laundering charge, specifically one that is considered a non-deportable offense. The client was sentenced to time served, avoiding further imprisonment and immigration consequences.
