Shamayev Business Law Evaluates U.S. Immigration Trends Amid Policy Shifts

Amid growing turbulence in U.S. immigration policy, demand for EB-category visas remains remarkably steady. Shamayev Business Law, a Miami-based immigration firm, reports consistent interest and approval rates, even as the federal government ramps up enforcement and tightens entry restrictions.

Since the start of 2025, immigration has returned to the forefront of the national agenda. The current administration has intensified deportation campaigns, bolstered border controls, and imposed new entry bans targeting select countries. Yet according to SBL, the number of approved immigration cases in the first five months of 2024 and 2025 remained unchanged—71 approvals each year. Since 2025 alone, the firm has helped secure over 3,400 successful outcomes, primarily for highly skilled professionals, entrepreneurs, and investors. The trend is backed by additional data. Take the surging interest in talent visas throughout 2025—no longer just among scientists and performers, but also tech professionals, founders, designers, athletes, and researchers. According to USCIS filings, applications for the O-1 visa jumped over 20% in the past year alone. In 2025, USCIS also introduced updated guidelines and requirements for talent visas, with a particular focus on tech professionals, startup founders, freelancers, and creatives.

“These figures show a stable demand for our services and a consistent rate of success,” the firm noted in its statement.

SBL also reported a sharp uptick in initial inquiries. In 2024, the number of requests for free profile evaluations nearly doubled, rising from approximately 7,000 in 2023 to 12,000. That momentum has continued into 2025, with 5,500 requests recorded by the end of May. Over the past three years, the firm has received inquiries from individuals in 44 different countries—highlighting the enduring global appeal of the U.S. as a destination for business and professional opportunity.

The firm’s internal analysis also tracks long-term trends across visa categories. For the past two years, the breakdown has remained consistent:

- EB-1, for individuals with extraordinary abilities or notable achievements, leads overall demand;

- EB-2 NIW, for professionals pursuing projects of national interest, ranks second;

- E-2 (investor visa) and EB-3 (employment-based immigrant visa) follow in joint third.

Industry experts point out that the sustained interest in EB-1 and EB-2 NIW visas reflects their relative legal predictability and independence from shifting quotas or humanitarian policy changes. Meanwhile, interest in investor and employment-based visas has remained resilient despite a more complex regulatory backdrop.
