New Jersey DUI Lawyer Rachel Kugel Explains Whether a DUI is Considered a Crime in NJ

The lawyer mentions that New Jersey does not consider a DUI a criminal offense. They are instead treated as traffic offenses. However, Because DUI is not considered a crime, there is nothing to expunge or clear from a person’s record.

“In New Jersey, DUI cases do not go to a jury trial. Despite this, the state takes drunk driving offenses seriously and imposes severe penalties on those convicted of the crime. New Jersey is committed to keeping its roads safe, and the stringent penalties for DUI offenses serve as a warning to those who may consider driving under the influence,” the New Jersey DUI lawyer says. 

The lawyer adds that DUI first-time offenders who have a BAC below 0.10% or 0.08% can face up to $400 in fines, a suspension of their license for 3 months, and up to 30 days imprisonment. The Intoxicated Driver Resource Center may require them to be present for at least 12 hours, and up to 48 hours. A BAC above 0.10% will result in more severe consequences, such as fines of $300-500, license suspensions of up to seven months, and even imprisonment for up to thirty days.  

Attorney Rachel Kugel says that individuals who are convicted of a second DUI offense in New Jersey can face harsher punishments. These penalties could include suspension of their driver’s license for two years and possible fines of up to $1000. A court can also order 30 days of community service or a 90-day jail sentence. For a period of one to three years, the offender will also need to attend Intoxicated Driver Resource Center.

Furthermore, the lawyer explains that only certain crimes can be expunged from criminal records under New Jersey state law. The good part about a DUI being a traffic offense is that the offender doesn’t have to face having a misdemeanor or felony on their criminal record. The bad part is that the DUI will stay on a driver’s New Jersey driving record indefinitely which can have a significant impact on a person’s life.

In the article, attorney Kugel says, “Because a DUI is so permanent in New Jersey, it’s important to face DUI charges with a strong defense before the conviction ends up on your record forever. Despite what the police or the prosecution may say, the evidence against you may not actually be that convincing. Parts of your case could have been mishandled. The officer may not have carried out your sobriety test properly. Depending on the facts, your defense could be enough to get your case dismissed.”
