The lawyer explains the legal limit of blood alcohol content, or BAC is 0.08%. If someone has been stopped while driving with a BAC of 0.08%, they can be charged with OWI or operating while intoxicated. There is zero tolerance for drivers under the age of 21 who are caught driving with a BAC of 0.02%. 

When a person is arrested for DUI, the immediate consequences can be overwhelming. They may be facing fines, jail time, and a criminal record, as well as the potential loss of their driver’s license and other penalties. Additionally, a DUI conviction can have long-term effects on a person’s employment and personal life. However, it is important to remember that an arrest is not a conviction and that a person has the right to defend themselves against the charges.

In the article, the lawyer says, “When people complain that they were not read their rights, they usually mean the Miranda Rights. These rights refer to a 1966 United States Supreme Court case called Miranda v. Arizona, which protects a person’s right to remain silent and not respond to questions after being arrested. The Miranda warnings protect the 5th Amendment Right to Remain Silent, but also the 6th Amendment Right to counsel.”

Furthermore, attorney Tafelski says that every person digests alcohol differently. Some may get drunk faster than others. Based on different factors like weight and age, a person’s tolerance to alcohol may be affected. Sometimes, a woman may reach a BAC of 0.08% faster than a man. The way alcohol is consumed can affect a person’s metabolism of liquor too.
