According to the Complaint, the Company made false and misleading statements to the market. Orphazyme’s arimoclomol was not an effective treatment for Inclusion Body Myositis (“IBM”). Arimoclomol was also not an effective treatment for Amyotrophic Lateral Sclerosis (“ALS”). The Company’s new drug application (“NDA”) for arimoclomol for the treatment of Niemann-Pick disease type C (“NPC”) was not complete and would require additional data to support its benefit-risk analysis. The FDA was not likely to approve the Company’s NDA for arimoclomol. Based on these facts, the Company’s public statements were false and materially misleading throughout the class period.
