Michigan Firearms Attorney Paul J. Tafelski Explains Concealed Weapons Violation in Michigan

Michigan firearms attorney Paul J. Tafelski releases a new article (https://www.michigandefenselaw.com/firearms-lawyer/) that discusses concealed weapons violations in Michigan. The lawyer mentions that the law in Michigan prohibits someone from carrying “dangerous weapons”, hidden firearms, or weapons on or around your body or in any vehicle. A violation of this law is called a concealed weapons violation.

According to the Michigan firearms attorney, “Michigan does have a concealed gun license (CPL) that allows people to carry weapons provided they meet all the requirements. An individual who is licensed to carry concealed firearms cannot have one on their person, or in their vehicle if they have any alcohol content of 0.02 or more or a controlled substance.”

The lawyer explains that if someone has a civil infraction, a misdemeanor, or a criminal charge, their concealed gun license (CPL) may be lost. Being arrested for an OWI while in possession of a gun will result in an additional charge. A separate charge will be added for possessing the gun while drunk driving.

Attorney Tafelski adds that being arrested for possessing a gun while drunk driving is a state law charge and will be prosecuted by the County/State prosecutor. Additionally, it is also a crime in Michigan to produce, distribute or sell certain weapons such as short-barreled shotguns and rifles.

In the article, weapons attorney Paul J. Tafelski also discusses the firearms prohibitions in Michigan. According to attorney Tafelski, there is a national baseline regarding the eligibility of individuals to possess and acquire firearms. Generally, federal law prohibits people from possessing or purchasing firearms if they are convicted for misdemeanors or domestic violence.

Furthermore, the criminal defense lawyer explains that the federal law is not able to include all the possible violations and this leaves a gap that permits high-risk individuals to legally possess and acquire guns. Anyone who is convicted of a felony or any “specified crime” is prohibited from possessing, using, transporting, buying, or shipping a firearm or ammunition.

Aside from the aforementioned, the state also prohibits handgun sellers from selling firearms or ammunition to anyone under arrest for a crime. Attorney Tafelski says that it is important for anyone who is accused of a concealed weapons violation to seek the help of a criminal defense lawyer as soon as possible.
