The lawyer mentions that aggravated assault is something where “the victim suffers obvious severe or aggravated bodily injury involving apparent broken bones, loss of teeth, possible internal injury, severe laceration or loss of consciousness.”

In the article, attorney Tafelski says that an aggravated assault can be charged as anything from a misdemeanor aggravated assault to a serious felony. The state will determine the charges to file based on the facts included in the case. Some factors that are used to determine an assault charge include the presence of a weapon, the intentions of the accused, the identity of the victim, the relationship between the accused and the victim, and the previous criminal history of the defendant.

Furthermore, the criminal defense lawyer adds that if someone is convicted of felonious assault or aggravated assault, they can be sentenced to up to four years in prison and a fine of up to $2000. For a misdemeanor assault, the punishment is less serious and can be punishable by up to 93 days in jail and/or a fine of not more than $500.
