Oakland County Super Drunk Driving Lawyer Paul J. Tafelski Discusses High Blood Alcohol Content (BAC) Offenses

Oakland County super drunk driving lawyer released a new article (https://www.michigandefenselaw.com/super-drunk-driving-lawyer/) explaining high blood alcohol content (BAC) offenses. The lawyer explains that high BAC convictions, where an individual was operating a motor vehicle with a BAC of 0.17 or higher, are addressed under Michigan’s Super Drunk Law. Offenders are subject to penalties as well.

According to the Oakland County super drunk driving lawyer, “Michigan’s Super Drunk Law imposes a required one-year alcohol treatment program, as well as license sanctions. Once an offender is convicted, their driving privileges will be suspended for one year. However, after the first 45 days, the offender may be allowed restricted driving if a breath alcohol ignition interlock device (BAIID) is installed in their vehicle.”

The lawyer explains that a conviction implies a costly and embarrassing interlock gadget can be introduced in the offender’s vehicle for 320 days. A BAIID is a breath liquor analyzer that has capabilities like a PC with memory. The driver is expected to blow into the gadget before starting the vehicle. If a BAC of 0.025 or higher is distinguished, the gadget will keep the vehicle from starting.

The offender is liable for the month-to-month cost of the BAIID, in addition to installation and eventual removal costs. The Secretary of State gives a rundown of endorsed BAIID installers. As of June 6, 2016, the BAIID should likewise incorporate a camera to record a picture of the driver. The gadget will likewise request arbitrary, or "rolling," retests while the individual is driving.

Attorney Paul J. Tafelski mentions that drivers in Michigan who use liquor or medications prior to driving a vehicle might be accused of operating while intoxicated (OWI) or operating while visually impaired (OWVI). A driver is viewed as inebriated when they have a blood alcohol content (BAC) of 0.08 or higher.

“Problems get even worse for repeat offenders of super drunk OWI. If someone is caught with a high BAC again, law enforcement will confiscate license plates on the scene and put a paper license in the window that signifies to other law enforcement that a driver is a repeat offender.” says the super drunk driving lawyer.
