  • ICE cannot enter a home or business without a judicial warrant, which must be signed by a judge and specify the location and individual in question. Administrative warrants alone do not grant ICE the authority to enter private property.
  • Individuals have the right to remain silent. Under the Fifth Amendment, people are not required to answer questions from ICE officers.
  • Probable cause is required for ICE arrests. Officers must base their suspicions on objective facts, not solely on an individual’s appearance.

Zepeda also advised green card holders to carry their documentation but noted that they are not required to answer further questions beyond providing identification. “Non-citizens have a right to due process, and everyone—regardless of immigration status—has constitutional protections under the law,” she said.
