Circular Compliance: The Environmental Nexus Between the US and Europe

The European Union is decisively strengthening its environmental legislation, with new regulations that directly impact foreign companies selling electronic, electrical and battery products in the European market. Faced with this complex and changing regulatory scenario, Circular Compliance, a consultancy specialising in WEEE compliance, is positioned as a key strategic partner for companies, especially US companies, seeking to maintain their competitiveness and legal compliance in the EU.

‘Many manufacturers and distributors are not aware that selling an electronic product in Europe means not only having a commercial presence, but also complying with a series of very strict environmental requirements,’ says director Jordi Turró.  Circular Compliance is responsible for facilitating this compliance, acting as a link between its clients, recycling organisations and national authorities in each EU country.

Circular Compliance offers a comprehensive service ranging from the legal registration of products to the periodic management of sales declarations and advice on eco-design and sustainability. Specialising in the WEEE Directive (Waste Electrical and Electronic Equipment), the company also manages compliance with battery and packaging, as well as providing technical support on new and emerging regulations.

New regulations: a race for compliance

Among the most relevant legislative changes coming into force soon is the new Packaging and Packaging Waste Regulation, which will oblige importers to comply with strict criteria for recyclability and traceability of materials. In addition, the new Battery Regulation will require batteries marketed in Europe to include detailed information on their composition, durability and recyclability, in addition to meeting more ambitious collection and reuse targets.

Another of the most disruptive changes is the imminent implementation of the Digital Product Passport (DPP), a digital system that will accompany every electronic product sold in Europe and will contain information on its origin, components, environmental impact and recyclability. ‘This passport will be mandatory for a wide range of products and represents a revolution in terms of transparency and traceability,’ explains the director of Circular Compliance.

In addition, the European legal framework is evolving towards new eco-design requirements, which will affect the way electronic devices are designed and manufactured. The new regulations require greater energy efficiency, repairability, availability of spare parts and reduced use of critical materials, which implies a redesign of many products currently on the market.

Opportunity for responsible companies

Far from being a barrier, Circular Compliance believes that these new requirements can be a competitive advantage for companies that anticipate them. ‘Companies that adopt a proactive compliance strategy will not only avoid penalties, but will also gain credibility with increasingly sustainability-sensitive European consumers,’ says the consultancy.

Based in Madrid and with a strong network of contacts with environmental authorities and recycling organisations across Europe, Circular Compliance has helped dozens of US companies launch and maintain legal operations in countries such as Germany, France, Italy and Spain. Its tailored approach and expert knowledge of the European regulatory patchwork allows manufacturers to focus on their business, with the peace of mind of being compliant.
