According to the personal injury lawyer, “Sometimes a percentage of fault can be distributed to even the injured party.  An injured person has a duty to mitigate the injured party’s own damages.  Illinois has a modified comparative negligence law.  The injured party can still claim compensation as long as you can prove that the at-fault party was 50% or more at fault to receive a verdict in your favor.  Even if you attempt to settle before trial, the at-fault party’s insurance adjuster sometimes will make an offer of a settlement to the injured party.”
