New Jersey Homicide Lawyer Adam M. Lustberg Explains Homicide and Murder in NJ

The lawyer mentions that few crimes carry a harsher penalty than murder. Facing a murder charge can be tough and can induce fear even in the toughest persons. The identifying factor on whether a homicide case is elevated to a certain degree of murder is the circumstances surrounding the case. 

“Homicide is the act of killing another person. Although homicide and murder are used interchangeably in media, they have very distinct legal definitions. In New Jersey, murder is referred to as unlawful homicide. This means that all murders are homicides, but not all homicides will lead to a charge of murder,” the New Jersey homicide lawyer says. 

The lawyer says that murder is legally defined as the intentional killing of another person in an unlawful and legally unjustifiable manner. Murder can also include “malice aforethought” which is the “premeditation” of the act of killing. Causing someone serious bodily harm which results in their death can also lead to a murder charge. 

Attorney Adam M. Lustberg says that homicide and murder both involve the killing of another person. However, there must be an element of premeditation and intent in order for a murder charge to be filed. Killing or inflicting serious harm resulting in the death of another person purposefully and knowingly is what constitutes a murder charge.

In the article, the lawyer adds, “Criminal offenses in NJ are not referred to as misdemeanors or felonies. Criminal charges are instead categorized between disorderly person offenses and indictable offenses carrying degrees from fourth to the first degree. Manslaughter, aggravated manslaughter, and murder are all indictable offenses that are subject to the No Early Release Act (NERA).”
