The lawyer explains that if someone has a case pending for terroristic threats, they may face severe penalties. If someone is convicted of terroristic threats, they may be facing 3-5 years in state prison. Terroristic threats can also include bomb threats or shooting threats.

Lustberg also says that someone will likely be charged with terroristic threats if they threaten to commit a violent crime with the purpose to terrorize another or cause evacuation of a building, place of assembly, facility of public transportation, or otherwise to cause serious public inconvenience.

“A person is guilty of a terroristic threats crime of the third degree if he threatens to kill another with the purpose to put him in imminent fear of death under circumstances reasonably causing the victim to believe the immediacy of the threat and the likelihood that it will be carried out,” says attorney Lustberg.

Furthermore, the criminal defense attorney says that terroristic threats carry penalties of 3-5 years in jail, a fine of up to $75,000, and a probationary period. However, if the threats were made during a state of emergency, it may be punishable with 5-10 years in jail, a fine of up to $250,000, and a probationary period.
