Michigan Expungement Lawyer Paul J. Tafelski Discusses What Convictions Are Eligible for Expungement

Michigan expungement lawyer Paul J. Tafelski releases a new article (https://www.michigandefenselaw.com/what-convictions-are-eligible-for-expungement.html) discussing what convictions are eligible for expungement. The lawyer mentions that if someone has a criminal record in Michigan, the recent passage of the Clean Slate Law may make it easier for them to get their record sealed. Getting a record expunged means that employers, landlords, and anyone else other than law enforcement would not see that the person has been convicted of a crime.

According to the Michigan expungement lawyer, “In 2021, Governor Whitmer signed the Clean Slate Law into law in response to the growing concern over the lingering effects of a felony conviction. This recognizes that people can make mistakes and that a misstep or two along the way shouldn’t impact the rest of their life. Thus, most misdemeanor and felony convictions are eligible for expungement under the new law.”

The lawyer adds that not everyone is qualified to get their record expunged. The first step to determining eligibility is checking the person’s record. As long as they do not have felonies, regardless of the number of misdemeanor convictions they have, they will most likely qualify for expungement.

Attorney Paul Tafelski adds that a person can have up to three felony convictions they can expunge. However, if they have more than three felonies, they will not qualify. Under the new law, a conviction of multiple offenses is treated as a single conviction as long as the crimes occurred within a 24-hour period and arose within the same series of events.

“Once you determine that you qualify based on your record, you next need to check if the convictions you seek to expunge are eligible. In other words, even if you only have a single conviction, you might not qualify based on the nature of the crime for which you were convicted. For example, a conviction for any crime punishable by life in prison cannot be expunged,” says attorney Tafelski.
