Criminal penalties usually mean that there is a possibility that the offender will face jail time. A lighter sentence could include five days in jail or up to 240 hours of community service. Second DUI offenders are not taken lightly by the state, however, and it is quite possible for an individual to find themselves facing even harsher penalties, including up to a year in prison or a fine of $2500. The circumstances surrounding the offense also affect the severity of the consequences. For example, the offender’s BAC is often taken into account, and a BAC reading above .16 means that the offender is legally required to serve jail time.

The first offense could lead to a license being suspended, but a second offense all but guarantees that it will be suspended immediately. Second offenders are legally barred from operating motor vehicles after they are charged. While it is possible to appeal this suspension, the period in which it is possible to do so is very short, and failure to submit an appeal means that the suspension will automatically go into effect. Usually, the suspension lasts 12 months, but certain factors can make it 36 months instead.
