Advocates on Wednesday will call for an investigation into the prosecution of a Holly Springs man charged in a series of pellet gun shootings from 2020.



Holly Springs pellet gun shootings: NAACP calls for investigation into case of Henderson Atwater

<p>That water was locked up during the peak of COVID-19. It was so long ago, we kind of forgot about that. According to the US Department of Justice, the Bureau of Statistics. During this time from February 2020 to the end of February 2021 the prison population declined by 215,800 persons. 24 states released a total of 37,000 persons from prison on an expedited basis earlier than scheduled during this specific time. State and federal prisons had a crude mortality rate of 1.5 COVID related deaths per 1000 prisoners. It is during this time that Mr Atwater was in jail when prisoners were being released around the nation. The Wake County District Attorney's office opted to jail Mr Atwater and kept him in jail for three years on allegedly shooting a BB gun in April of 2020. Law enforcement reported that the subject was a young white male despite this evidence, Mr Atwater has been the target of this investigation later on. Law enforcement altered their report to state now that the driver was a black male during the time Mr Water was in jail. His mother died and tragically, his son was found dead in the same jail where Mr Atwater was incarcerated. Mr Atwater's bond was set at $3.5 million and he is potentially facing over 200 years in prison for allegedly shooting a BB gun. The N A AC P has been fighting for justice in Mr Atwater's case. We after calling on the FBI to investigate this case as culp toy evidence was turned over by the District Attorney's office. 2.5 years later, the District Attorney's office and law enforcement were aware of the identity of the shooter but deliberately ignored the evidence. In August 2023 Mr Atwater was tried on 17 counts ending in a mistrial. During the trial, the jury could not see the espy evidence withheld from the evidence from the defense. Yet the District Attorney's office could not convict Mr Atwater on one charge. Some of the evidence withheld from the defense and jury are the discovery in June of 2023. A previously undisclosed report confirmed the clandestine use of license plate readers known as L pr s and videos in a surveillance operation for a man accused of shooting a BB gun in July 2023. And on this close report, it was provided to the defense stating that on June 30th 2024 years ago at 1245 no leads were developed by the Holy Springs Police Department from the information regarding Henderson at water. A police report withheld until July 2023 showing a young white male was arrested and charged with multiple counts of property damage. On July 6th 20 20/4 years ago for shooting cars with a BB gun. No evidence. Uh New evidence reveals that many of the shootings were committed with a BB gun, not a pellet gun as initially claimed by the government. Mr Atwater was accused of using a single shot pellet rifle which is incompatible with belief. This discrepancy was highlighted to the prosecutor in October 2021 and reiterated in the motion to dismiss this case for outrageous government conduct. Despite the District Attorney's awareness, this key evidence was withheld days before his trial and over 2.5 years later, with held photographs reveal that many vehicles were hit multiple times by a moving car which is impossible according to firearms expert, it is impossible for this to happen with a single shot pellet gun. Ladies and gentlemen, two days ago, I said Los Dias two days ago on July 8th, 2024. After hours hours after we released the N A AC P released a press release about this conference. A judge, a judge signed an order for the defense to have access to Mr Waters phone record that the government has been in possession since 2021. This delay is a further example of obstruction and misconduct of the government. No evidence from the covert surveillance operation has been turned over to the defense and the defense did not know about this operation until a report was disclosed. Over 2.5 years later, we demand that the Department of Justice take immediate action to rectify this injustice. All charges against Mr Henderson at water must be dropped immediately. Measures must be taken to prevent such miscarriage of justice in the future. No one should be punished for a crime. They did not commit Mr Anderson. Hatch water has suffered enough. The evidence proves Mr Atwater is innocent. The N A AC P will continue to fight until justice is served. People must be held accountable. I told the world more than a year ago. Right here on May 10th 2023 I told the world this man is innocent. We thank God that he's here today. Henderson out water, but then he was still in jail and we told the District Attorney's office and we told the world this man is innocent. We pray that the government will do what is right and stop this miscarriage of justice. Dr Martin Luther King said the time is always right to do what is right. Miss that water has suffered enough. His family has suffered enough and this community has seen enough. We are tired of the injustice against people of color, against the poor, against the indigent. There are thousands of Henderson at waters, right now locked up in jail who are innocent and are facing a criminal justice system that victimizes people of color, that victimizes the poor, that victimizes the indigents. We are tired. Many individuals are facing charges, they did not commit simply because they cannot afford good legal representation. They know that and the amount, that's something the media can figure out the amount of money the District Attorney's office is pending to investigate and prosecute a man for shooting a BB gun is incomprehensible. Let us assume for a second it was him, which is not, but let us assume for a second he did it. Why are they spending so much money on this case? So I think your investigation reporting will, there's no more facts we can give, we've given you all the facts.
