Fayetteville police officer charged with obtaining property by false pretense

<p>By false pretense, a criminal investigation involving Sergeant Brian Gerbert and his actions related to off duty employment with the market fair. NC LLC has led to probable cause for the issuance of 12 felony warrants for obtaining property by false pretense with an amount over $20,000. I will repeat these charges are in reference to Sergeant Gerber's off duty employment separate apart from his duties as a fabled police officer. As of this morning, sergeant, Gerber was served with the 12 warrants for arrest. Additionally, a consideration of dismissal was served by the police department. Sergeant Brian Gerber has been employed by the fable police department since 2017 and up until the day, his assignment was with our patrol division. The purpose of this press conference press release is to assure our community that accountability and transparency are being exercised within the Fayetteville Police Department. We hold all employees both sworn and non sworn to the highest legal and ethical standards that's into my statement and I'll entertain a few questions. So you said he was employed, um, repeat that who he was employed by and what was his, what was he supposed to be doing and was he in uniform at the time? Yes, it was, it was his off duty job working with Market Fair uh NC LLC. And it was to provide police services in an off duty capacity as a security officer, as a police officer in off duty capacity. And he was in uniform while he was supposed to do that, he was supposed to be in uniform. And so these, these charges are because was he, was he not there? Was he punching and saying he was there and was not there? How does that work? So there are some things intricacies to the investigation that are still ongoing and I'm not ready to reveal those points of the investigation at this point in time. Uh again, part of the, the ongoing investigation and not information that I'm ready to, to release at this time. Uh II I gave as much as I can in this press release, you know, we, we talked about things that, that, that have come up in the past about what is their current, you know, status, you know, who are they? You know, and again, I tried to give as much information as I could in the initial press release here does not affect the ongoing criminal and administrative investigation. Is this the first officer since you've been police chief that you've had to fire? No, it's not the first I've had to fire. Well, I mean, for criminal charges, no, it's not I, I think we're all aware that there's been two previous officers that were arrested for criminal activity during my tenure as the chief of police and, and your feelings about that, you know, officers are held to a higher standard when something like this comes across your desk, what comes across your mind? So, and I, I'll say something that I've been saying to all the police officers across the department, uh, ever since the first officer was arrested, you know, it, it's, it's imperative that we have definitions that we can work with as police officers. The definition of ethics is one of those things. To me, the definition of ethics is the expectations or the code of conduct that's placed upon you based on your role, title position or profession. Ok. There are certain things that the average person can probably do or get away with that. We can't allow our police officers to do or get away with and once they cross that line and they break the law, that is definitely not something we can allow them to get away with. Do you have any suspicion that others may have been involved? Uh, not a part of this internal investigation? No. Uh but again, we stay vigilant to, to, to make sure that our supervisors stay on top of the actions and activities of our officers to correct behaviors before they become unethical or illegal. It is good. Go ahead. Why is it so important for you as chief since becoming chief to let the community know that you're holding these people accountable within your own. Well, a as we know, there's been calls in this community itself at council meetings and, and, and other forms across the board that, that this department requires civilian oversight. I think it's important that I get up here and do this press conference and, and let you guys know today what we are doing to provide that accountability and transparency. Ok. You know, to counteract some of those arguments and conversations that we aren't able to do this ourselves. You know, I've, I've stood behind this podium at least three times to prove that the fabled police department is willing and able to hold itself accountable when it's necessary. Can you hear where you found him when you arrested him and the conditions he was in at the time? Uh That's not something we're willing to share right now. Uh II I will say this, he's been cooperated throughout the process and over what period of time we were these 12 charges accumulated yet. It, it's one of those situations where we're still investigating, you know, to look, uh there is substantial evidence for these. It's been over a period of months. Do you expect more charges added? That's something I can't comment on right now. I think it has to be uncovered as we continue to investigate and close this one out and as in his capacity as a security person at that mall, did he make any arrests or anything where these cases might be in jeopardy? Because he's been charged. I don't have any of that information. What his arrest was at that job was the officer, uh, involved, uh, able to supervise any other officers, uh, within the department. So, his rank was sergeant and, uh, he was over, uh, a supervisor for a patrol unit. When was the officer hired, uh, in 2017? All right. Well, Chief, you, you said you, you starting the process for dismissal. So he is still employed with the police department right now, or has he been dismissed? So, again, like with any process, you know, that, that, that cod has been issued and it will go through the, the finalization through his personnel. And so is he without pay? What, what is his status right now? And you've been charged by now? He's been served his consideration of dismissal. So, without no pay at this point, that means he would be dismissed. All right. Thank you for coming. Just to see you in this way.</p>
