If a person is arrested for DUI and refuses either the data master test or a blood draw if requested, their driver’s license will be administratively suspended for one year or longer. They will then gave have 14 days from the date of their arrest to request a hearing with the Michigan Secretary of State’s Driver Assessment and Appeal Division. 

The lawyer adds, “If you fail to request the administrative hearing, or the Driver Assessment and Appeal Division upholds the suspension, you will lose your driving privileges for one year for a first violation of the implied consent law or two years for a second refusal within seven years. Apart from the breath refusal cases, a Michigan DUI first-time offender may receive up to six points on their driving record. Their driver’s license could be suspended for up 6 months and their license could be restricted after 30 days. The first offense of operating while visually impaired will result in a restricted license for 90 days.
